Types of Spinal Cord Injuries

Spinal cord injuries include whiplash, bruises forming along spinal blood vessels, and joint injuries that can prevent or inhibit mobility. When the spinal cord is severed, fully or partially, the result is often paralysis.

Partial paralysis

This condition occurs when specific areas cannot respond to nerve impulses, such as the arm, the hand, or a part of the leg, due to spinal cord damage.

Hemiplegia

This form of paralysis is when one side of the body is paralyzed, either the entire left or right side, as a result of a spinal cord injury.

Paraplegia

Caused by a spinal cord injury in the lower back, this condition is when the person can no longer control the use of their legs and lower body.

Quadriplegia

A type of paralysis in which the body below the neck is paralyzed. The injured individual will require a lifetime of medical care.

What is My Case Worth?

Due to the catastrophic nature of a spinal cord injury, cases can be valued up to millions of dollars. Each case is unique and has several factors that determine the outcome; claim values should reflect the severity of the injury. The more disastrous the event has been on the injured person, the higher the claim value is likely to be.

Damages in Spinal Cord Injury Claims

Damages pursued after a spinal cord injury can include the following:

  • Lost wages: During your initial healing period, while you are away from work, the amount you would have been paid may be compensated for.
  • Loss of future earning potential: If you become paralyzed or are no longer able to hold the same job due to physical setbacks from your spinal cord injury, the amount of money you could have made but are now losing can be calculated. If you consider one physically sound person can make $30,000 to $60,000 a year, being injured at 30, while there are still 30 working years ahead, the numbers add up quickly.
  • Medical devices: The use of wheelchairs and other supportive devices is costly. Covering these costs is a meaningful way to reduce the financial burden on the injured person.
  • Home modifications: If a stair lift or other specialized equipment needs to be installed to make it possible to live in your home, these costs may be claimed as damages.
  • Pain and suffering: While more challenging to value, claims can include non-economic losses such as pain and suffering and the mental anguish and stress resulting from extreme changes in lifestyle and abilities.
  • Loss of consortium: The love and support one gives and receives in a relationship with a partner or spouse is a critical aspect of life experience and enjoyment.
